5. By derogation from paragraphs 1 to 4, a contracting party may export or import skimmed milk powder and buttermilk powder for animal feed at prices below the minimum prices set for these products in this appendix, under the following conditions. A contracting party can only make use of this ability to the extent that it ensures that exported or imported products are subject to procedures and controls applied in the export or destination country to ensure that skimmed milk powder and buttermilk powder thus exported or imported are used exclusively as animal feed. These procedures and controls have been approved by the Committee and recorded in a register it establishes.11 A contracting party wishing to avail itself of the provisions of this paragraph notifies the committee, which, at the request of a contracting party, meets to review the market situation, its intention to do so in advance.
